Abstract | Uspostavom slobodne i neovisne Republike Hrvatske uspostavljeni su i novi društvenoekonomski odnosi koji se temelje na privatnom vlasništvu i trţišnom gospodarstvu. Prema Ustavu poduzetništvo i trţišna sloboda su temelj gospodarskog ustroja Republike Hrvatske. Pravo na rad propisano je odredbom Ustava RH prema kojoj svatko ima pravo na rad i slobodu rada. Svatko slobodno bira poziv i zaposlenje i svakom je pod jednakim uvjetima dostupno svako radno mjesto i duţnost. Ovdje se dakle govori o slobodi rada, što znači da se svatko moţe zaposliti gdje hoće i kada hoće, posao moţe pokrenuti sam ili raditi kod poslodavca pronalaskom posla na trţištu rada. Stanje na trţištu rada je takvo da je znatno veća ponuda radne snage od potreba. U takvim je uvjetima iznimno teško pronaći posao. Prema ustavnim odredbama drţava potiče gospodarski napredak i socijalno blagostanje gaĎana, te brine za gospodarski razvitak svih svojih krajeva. Drţava dakle treba svojom pravnom regulativom stvoriti uvjete za nesmetan gospodarski razvitak, jer samo se gospodarskim razvitkom mogu osigurati i radna mjesta. Radna mjesta trebaju osigurati imaoci sredstava, a drţava svojim mjerama (npr. porezna politika, poticajne mjere, itd.) treba stvarati okvire i ozračje za razvoj poduzetništva i gospodarstva u cjelini. Pravo na rad nije pravo na radno mjesto, jer je iz ekonomskih razloga nemoguće osigurati svima radno mjesto, već se pod pojmom ''prava na rad'' podrazumijeva jednako pravo pod jednakim uvjetima. Pravo na rad je jednako pravo, pod jednakim uvjetima, zajamčenog zaposlenja od strane društvene zajednice svakom za rad sposobnom graĎaninu prema njegovim stručnim i fizičkim sposobnostima, zaposlenje koje on slobodno izabere i koje za njega predstavlja osnovni i glavni izvor materijalnih sredstava i drugih prava za pristojan i osiguran ţivot i razvoj njegov i njegove obitelji. Jedan dio završnog rada posvećen je odnosu zaposlenika u HEP – u, odnosno njihovom radnom odnosu. |
Abstract (english) | By the establishment of the free and independent Republic of Croatia, new socioeconomic relations based on private ownership and market economy were also established. According to the Constitution, entrepreneurship and market freedom are the foundation of the economic structure of the Republic of Croatia. The right to work is regulated by the provision of the Constitution of the Republic of Croatia according to which everyone has the right to work and freedom of work. Everyone freely chooses a call and a job, and each is at equal service with every job position and duty. Here, therefore, is talk of freedom of work, which means that everyone can hire where he will and when he will, the job can run alone or work with the employer in finding a job on the labor market. The labor market situation is such that there is a considerably greater supply of labor than needs. In such circumstances it is extremely difficult to find a job. According to the constitutional provisions, the state promotes economic progress and the welfare of the defendants, and cares for the economic development of all its regions. The state therefore needs to create the conditions for undisturbed economic development by its legal regulations, since only economic development can provide jobs. Workplaces need to be provided by funders and the state should, through its measures (eg tax policy, incentive measures, etc.), create frameworks and environments for the development of entrepreneurship and the economy as a whole. The right to work is not a right to a job, because it is impossible to provide all jobs for economic reasons, but the term "right to work" implies equal rights under equal conditions. The right to work is the same right under the same conditions as the guaranteed community-wide employment for every citizen capable of working for a competent citizen according to his professional and physical abilities, the job he freely chooses and which constitutes the basic and main source of material and other rights for a decent and secured the life and development of his and his family. Part of the final work is dedicated to the relationship of employees in HEP, i.e. their employment relationship. |
